Terms of Service

These Terms explain how you can use K-Pop Marketplace, what sellers and buyers are responsible for, and how payments, disputes, and platform rules are handled.

Effective date: April 28, 2026

1. Overview

These Terms of Service govern your access to and use of K-Pop Marketplace, including our website, seller tools, checkout flows, and related services.

By using the platform, you agree to these terms. If you do not agree, do not use the service.

2. Eligibility and Accounts

You must be legally able to enter a binding agreement in your jurisdiction.

You are responsible for maintaining accurate account information and for all activity under your account credentials.

We may suspend or terminate accounts that violate these Terms or applicable law.

3. Marketplace Roles

Our platform connects sellers and buyers of products and digital goods.

Sellers are responsible for product listings, pricing intent, delivery commitments, and content accuracy.

Buyers are responsible for reviewing product details before purchase and using purchased items lawfully.

4. Payments and Fees

Payments are processed through third-party payment providers and are subject to provider terms.

Platform fees, processing fees, taxes, and payout schedules may apply and may change over time with reasonable notice.

We may hold, offset, or delay funds where needed for disputes, risk review, chargebacks, compliance, or fraud prevention.

5. Refunds, Chargebacks, and Disputes

Refund decisions may depend on the product type, seller policy, purchase history, and abuse prevention signals.

If a payment dispute or chargeback is opened through a payment provider, we may decline duplicate in-platform refund requests for the same transaction.

Sellers agree to cooperate with requests for supporting evidence in dispute investigations.

6. Prohibited Conduct

You may not use the platform for unlawful, fraudulent, abusive, discriminatory, deceptive, or harmful activity.

You may not upload malware, infringing content, or products prohibited by our policy or payment network rules.

You may not attempt to bypass platform fees or move platform-originated transactions off-platform to avoid terms.

7. Content and Intellectual Property

You retain ownership of content you upload, but you grant us a limited license to host, display, process, and distribute it as needed to operate the service.

You represent that you have all rights required to publish your content and grant required permissions.

We may remove or restrict content that violates these Terms, legal obligations, or safety standards.

8. Third-Party Services

Our service may integrate with third-party tools, websites, and infrastructure providers.

We are not responsible for third-party products or services, and your use of them is subject to their own terms.

9. Availability and Changes

We may update, modify, suspend, or discontinue any feature at any time.

We may release updates, fixes, and new functionality without prior notice where appropriate.

We do not guarantee uninterrupted availability or error-free operation.

10. Disclaimers

The platform is provided on an as-is and as-available basis to the maximum extent permitted by law.

Except where required by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from platform use.

Our total liability for claims related to the service is limited to amounts paid by you to us in the period directly preceding the claim, unless law requires otherwise.

12. Indemnification

You agree to indemnify and hold K-Pop Marketplace and its affiliates harmless from claims, losses, and costs arising from your content, your use of the platform, or your breach of these Terms.

13. Governing Law and Disputes

These Terms are governed by applicable law as stated in our legal notices and required local consumer protections.

Where permitted, disputes will be handled through the dispute resolution process defined by our service policies and applicable legal requirements.
